Disclaimer and Software License Agreement
By using MyGains, you are agreeing to comply with all terms contained in this License Agreement. Users of MyGains must accept this disclaimer of warranty: "The Software is supplied AS IS. Dhana Software Inc. disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. Dhana Software, Inc. assumes no liability for damages, direct or consequential, which may result from the use of the Software."
The trial version of the Software is provided at no charge to the user for an evaluation period of 30 days, after which it will cease function. If you would like to continue using the software after the evaluation period, you must purchase a license (see the Ordering Information for details). When you purchase a license, you will receive a Registration key that will unlock the Software’s functions. The license key will allow the user to use the Software on any one computer at any one time. Please note that the software collects your computer’s motherboard and processor ID for verification purposes. All information collected by Dhana Software is kept confidential and Dhana Software Inc. does not share the information with anyone else.
MYGAINS IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. DHANA SOFTWARE, INC. AND THE AUTHOR FURTHER DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. Unless otherwise specified, Dhana Software, Inc. operates from our office within the State of California, United States of America. Dhana Software does not claim that MyGains is appropriate for use in locations other than the United States. By using MyGains, you agree that the laws of the State of California, United States of America, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and Dhana Software, Inc. or its affiliates. If you take legal action relating to these Terms and Conditions, you agree to file such action only in the Ventura County, State of California and you consent and submit to the personal jurisdiction of those courts for the purposes of litigating any such action.
All Title, ownership rights, and intellectual property rights in and to the Software shall remain with Dhana Software, Inc. You agree to abide by the copyright law and all other applicable laws of the United States. You acknowledge that the Software in source code form remains a confidential trade secret of Dhana Software, Inc therefore you agree not to modify the Software or attempt to decipher, decompile, disassemble or reverse engineer the Software, except to the extent applicable laws specifically prohibit such restriction.
